You got a corporate shill to agree they should file a claim with their insurance? I'm not trying to take anything away from the anguish you must have felt, but this is hardly a moral victory. I've been the corporate shill before...shocked and horrified is the only appropriate response in such a situation, and I could fake it with the best of them. This guy isn't heartbroken or considering quitting, he's just taking the next call and figuring out which fake emotion it calls for, if he's any good at his job. He even got you to do the job of calling the store, and stuck them with filing the claim with their insurance company, who will then subrograte the claim to the manufacturer's insurance company, failing to even cause a ripple, as far as PetCo is concerned. When you get the call from the insurance company, politely mention that you're considering seeking damages in the amount of... dun dun dun...just slightly less than whatever the small claims limit is in your state. It's cheaper for them to settle than it is to show up and win. They will try to negotiate, but when pressed, will settle.

Glad Jennyr's feeling better though.

Thanks for the advice Rev, I'll take it and do so.

I didn't call the store, I walked in the next day, and the manager knew me by name, as well as a vague oversight of the problem, with the claim already in hand.

Satisfactorily expeditious.

I can only hope they'll be similar through the last half of the battle.

If you really want to throw 'em for a loop, find out from your Secretary of State's office who their attorney of record is in your state, and contact them. Or save that trick for if the insurance company decides to play hardball.

How would I go about doing that? This is only the second time I've ever had to do something like this, and the first time was fairly straightforward and never even hit court.

As soon as they realized I was actually serious(I forgive them for not realizing it sooner. I'm small, female, and sweet. How serious could I be? >.<) they practically threw money at me to avoid getting their name tarnished with even the slightest "legal" issue.

Yay for small businesses?

Yeah, small businesses have a lot more to lose. If you're dealing with a billion dollar company, keep in mind that a million dollars isn't even a decimal point at the end of the year, and that smaller amounts are even less significant. Time is almost as valuable a commodity to them, and if you demonstrate you're willing to take it up, they'll try to make you go away so that they can better spend their time on more profitable things.

As far as contacting their attorneys, you're probably better off waiting to see how things play out with insurance. If they don't play ball, send a polite, well thought out letter to PetCo's attorneys explaining that you're not satisfied with the manner in which negotiations are proceeding, and requesting to verify that they are who you send the subpoenas to if further action is required. Expect the insurance company to get very cooperative after that..

Jennyr needs to go BACK to the vet tomorrow. Apparently this issue gave him Canine Colitis. So we're headed back in to run some tests. The vet said if it IS colitis - he won't get better. He'll be on a nazi-strict diet for the rest of his life, as well as being on and off meds to manage symptoms.

So - I've got something of a fire under my butt about this right now.

I've hardly even started playing ball and I'm this |....| close to being ready to take the gloves off.

But, patience is not something I lack. I just don't like it much. :\
