Personally I've always used the word "can". Usually when being asked if *insert snake species here* bites. I always tell them that anything with a mouth can bite, but that doesn't mean it will. Although I'm sure that's not true for all species, there's some critters that have mouths but lack the ability to bite.
But "Anything with an anatomically suitiable jaw structure can bite" just doesn't have the same ring.
And I know what you were getting at. I was just being difficult.

Guess I should add that a tiny one like this is quicker than an adult, and I grabbed him, ignoring the obvious signs that he was preparing to strike. He was about to go through the wall of the shed, and I knew a hit would cause little damage. You can't hold a baby snake without having your hands within striking distance.
